What is a type A work permit?
A work permit type A is a document that allows legal employment of foreigners in the territory of Poland. It is required when the employee comes from outside the European Union, the European Economic Area, Switzerland or the United Kingdom. The authority processing the application for a type A work permit is the Provincial Office for the seat of the company or according to the permanent place of business activity. Submission of the application involves an administrative fee of PLN 100. The cost of the work permit is paid by the employer, and processing usually takes 2 – 4 months from the date of submission, depending on the complexity of the case.
What should an application for a type A foreigner work permit contain?
An application for a Type A work permit should include information about both the entity entrusting the work and the foreigner himself. The entrusting entity should provide the name of the company, the address of its headquarters, its Tax Identification Number and its PKD symbol. On the other hand, in the case of the foreigner, his name and travel document number should be provided.
The document should also contain information about the work to be entrusted to the foreigner. This means stating the position of the job, the place where it is to be performed, the type of contract, the full-time equivalent, the rate of pay and the period for which the work is to be entrusted.
For what period is a type A permit issued to a foreigner?
The permit can be granted for a maximum of 3 years. After this, it is possible to extend the type A work permit, but not earlier than 90 days before the expiration of the permit. A type A work permit alone does not legalize a foreigner’s stay in Poland, and therefore is not sufficient for employment, unless the foreigner additionally holds a visa, residence permit or biometric passport.
