What documents are required when hiring a foreigner?

Hiring employees, whether Polish citizens or foreigners, is a process that requires understanding and adhering to labor law regulations. Ensuring that you have all the necessary documents is crucial for the legality and correctness of the employment process. In the case of hiring a foreigner, the process can be more complex.

Here are the essential documents to consider:

  • Passport or other travel document;
  • Visa and residence permit – Depending on the foreigner’s country of origin, a visa or residence permit in Poland may be required. For permanent employment, a permanent residence permit might be necessary;
  • Residence card – After arriving in Poland, a foreigner may apply for a residence card, known as a unified residence and work permit, which can also serve as the basis for the employment process. However, it’s important to note that the residence card (physical card) is valid along with the issued decision;
  • A statement of entrusting work to a foreigner issued by the MUP (Labour Office) also serves as a document legalizing employment;
  • Documents confirming qualifications and professional experience.
In some cases, a certificate of no criminal record may be required, confirming the absence of a criminal background. Due to the current situation in Ukraine, employers hiring Ukrainian workers for work exclusively in Poland can legalize their stay and employment by notifying the City Labour Office (MUP) through a UA notification.

It is important to remember that the above list of documents is general, and specific requirements may vary depending on the position and individual circumstances.
